Terms of Service

These Terms of Service (the "Terms") are an agreement between you and ZKtutors LLC, an Illinois limited liability company ("ZKtutors," "we," "us") governing your use of zktutors.com (the "Site") and our tutoring services (the "Services"). By using the Site, booking a consultation, or purchasing a session, you accept these Terms. If you do not agree, please do not use the Site or Services.

1. Eligibility; parents and guardians

You must be at least 18 years old and legally able to enter contracts to book Services. Tutoring for a minor student may be arranged only by the student's parent or legal guardian, who accepts these Terms on the student's behalf and remains responsible for the account, payment, and the student's participation.

2. The Services

ZKtutors provides supplemental, 1-on-1 educational tutoring in mathematics, computer science, and SAT/ACT preparation for students in grades 5–12, delivered live over Zoom. The Services are educational support only: they are not a school, a credentialing program, licensed therapy or counseling, or special-education services, and they are not a substitute for classroom instruction.

3. Scheduling, rates, and payment

  • Current rates are published on the pricing page. Each "hour" lesson consists of 55 minutes of live instruction, with the remaining time used to prepare the written session report;
  • Payment is due at or before each session, or at the time of purchase for session packages, using the payment methods we make available;
  • We may change published rates at any time. Rate changes never affect sessions already paid for (including package sessions), and current clients receive at least 30 days' notice before a new rate applies to them.

4. Cancellations, rescheduling, and no-shows

  • You may cancel or reschedule any session free of charge with at least 24 hours' notice;
  • Sessions cancelled with less than 24 hours' notice, and missed sessions without notice, may be charged in full;
  • If we must cancel a session, you will be offered a make-up session or a full credit or refund for that session;
  • If a session cannot proceed because of technical failure on our side, we will reschedule it at no charge. Please test your student's device, camera, and connection before the first session.

5. Session packages

Session packages are valid for 180 days from the date of purchase. Unused package sessions are refundable at the discounted per-session price paid, on request, at any time before the package expires. Sessions remaining after expiration are forfeited unless we agree otherwise in writing.

6. Free consultation

The free 15-minute consultation is an informational conversation, provided without charge and without obligation on either side. It does not create a tutoring engagement until a session is booked and paid for.

7. Conduct, environment, and recordings

  • Students are expected to attend on time, in a quiet space suitable for learning, with the materials needed for their coursework;
  • Parents and guardians are welcome to observe any session, and we encourage a parent to be reachable during sessions with younger students;
  • We are committed to a respectful environment and expect the same: we may end a session, or the engagement, in the event of abusive, harassing, or inappropriate behavior — with unused prepaid amounts refunded;
  • Sessions are not recorded by ZKtutors except with advance parental consent, and families may not record sessions without our consent.

8. Academic integrity

Tutoring is designed to teach. We will not complete graded assignments, write papers, take tests or assessments on a student's behalf, or otherwise help a student submit work that is not their own — including during live proctored or take-home exams. We may decline requests of this kind and may end an engagement over them, with unused prepaid amounts refunded.

9. No guarantee of outcomes

We work hard for every student and report progress transparently, but grades, test scores, and admissions results depend on many factors beyond any tutor's control. ZKtutors makes no guarantee of any particular grade, score, score improvement, or admissions outcome, and nothing on the Site (including testimonials, which reflect individual experiences) should be read as such a promise.

10. Intellectual property

The Site and all materials we provide or create for sessions (lesson plans, worksheets, practice problems, session reports) are owned by or licensed to ZKtutors and are provided for the personal, non-commercial use of the enrolled student and their family. They may not be republished, resold, or distributed without our written permission. Work product the student creates (their code, essays, solutions) belongs to the student.

11. Testimonials and feedback

We publish client testimonials only with permission. If you send us feedback or suggestions about the Services, we may use them without restriction or compensation — that never includes publishing your name or your student's information without consent.

12. Third-party services

Scheduling, forms, payments, video sessions, and analytics are provided by third parties (currently Calendly, Formspree, Zoom, Google, and our payment providers). Your use of those services is governed by their own terms and privacy policies, and we are not responsible for their acts or omissions. Our Privacy Policy describes how information is handled and is incorporated into these Terms.

13. Disclaimers

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

14. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: (A) ZKTUTORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR LOST DATA, ARISING FROM OR RELATED TO THE SITE OR SERVICES; AND (B) ZKTUTORS' TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SITE OR SERVICES WILL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID US IN THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR $100. THESE LIMITS DO NOT APPLY TO LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.

15. Indemnification

You agree to indemnify and hold ZKtutors harmless from claims, losses, and expenses (including reasonable attorneys' fees) arising from your material breach of these Terms or your misuse of the Site, except to the extent caused by our own breach or misconduct.

16. Term and termination

Either party may end the tutoring relationship at any time, for any reason, by written notice (email suffices). Upon termination, unused prepaid sessions are refunded as described in Sections 4 and 5. Sections that by their nature should survive (including Sections 8–15 and 17–18) survive termination.

17. Governing law and disputes

These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law rules. Before filing any claim, you agree to contact us at zoa@zktutors.com and attempt in good faith to resolve the dispute informally for 30 days. Any claim that is not resolved informally must be brought exclusively in the state or federal courts located in Cook County, Illinois, and both parties consent to personal jurisdiction there — except that either party may bring an individual claim in small claims court where jurisdiction permits.

18. General

These Terms, together with the Privacy Policy and any written engagement communications, are the entire agreement between you and ZKtutors about the Site and Services. If any provision is held unenforceable, the remainder stays in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them to a successor of the business. Neither party is liable for delay or failure caused by events beyond its reasonable control, except for payment obligations. Notices to you may be given by email to the address you provided.

19. Changes to these Terms

We may update these Terms from time to time. The current version will always be posted at this page with its effective date; material changes affecting current clients will be communicated by email at least 14 days before they take effect. Continued use of the Site or Services after a change takes effect constitutes acceptance.
